How to ensure an open architecture for data flows?

The transatlantic economy is powered by cross-border data flows. However, the decision by the Court of Justice of the European Union to invalidate the Safe Harbor agreement between the EU and the United States has ushered in a great amount of legal uncertainty for data transfer between the two. While the decision has been subject to different interpretations, it raises the question: what action is required now to ensure that current regulations do not encumber transatlantic data flows?
